1. AGREEMENT TO TERMS
By accessing or purchasing any product, course, membership, or community access from Digital Founder Academy ("we," "us," or "our") at https://www.digitalfounderacademy.com, you ("User," "Member," or "you") agree to be bound by these Terms and Conditions in their entirety. If you do not agree to these terms, you must not access or use our products or services. These Terms constitute a legally binding agreement between you and Digital Founder Academy. We reserve the right to update or modify these Terms at any time. Continued use of our products or services following any modification constitutes your acceptance of the updated Terms.
2. PRODUCTS AND SERVICES
Digital Founder Academy offers digital educational products, online courses, community membership, mentorship access, and related resources (collectively, the "Products"). Access to the Products is provided on a one-time payment or subscription basis, as specified at the time of purchase.
2.1 Entrepreneurs Academy Membership
The Entrepreneurs Academy is a digital community and course bundle that includes, but is not limited to: • Access to 9+ premium online business courses • Membership in a private online community of entrepreneurs • Weekly live strategy calls with experienced operators • 1:1 business mentorship access (subject to availability) • Lifetime resale rights (see Section 6)
2.2 Individual Courses
Digital Founder Academy also offers individual digital courses. All course content is delivered digitally via our platform. No physical goods are shipped.
3. Payment and Pricing
All prices are displayed in United States Dollars (USD). Payment is due in full at the time of purchase unless otherwise specified. By completing a purchase, you authorize us to charge your chosen payment method for the amount displayed at checkout. Digital Founder Academy reserves the right to change pricing at any time. Price changes do not affect purchases already completed. Promotional pricing is time-limited and may be withdrawn at any time without notice.
4. Access and Delivery
Upon successful payment, you will receive access to your purchased Product(s) via email confirmation and/or through your account on our platform. It is your responsibility to provide a valid email address and to ensure that communications from us are not filtered as spam. Digital Founder Academy grants you a non-exclusive, non-transferable, personal license to access and use your purchased Product(s) for your own educational and business purposes. You may not share, sell, sublicense, or transfer your account login credentials to any other party (resale rights, where applicable, are governed separately under Section 6).
5. Refund Policy
Digital Founder Academy stands behind the quality of our Products and wants every Member to succeed. We offer a conditional 7-day money-back guarantee as described in this section.
5.1 Action-Based Refund Requirement
We believe results come from implementation. Our refund policy is therefore actionbased. To be eligible for a refund, you must demonstrate that you have genuinely attempted to use the Product and have followed the steps below before requesting a refund. To qualify for a refund, ALL of the following conditions must be met:
1. Complete the Course(s): You must complete 100% of the course content purchased (or, in the case of the Entrepreneurs Academy membership, complete at least one (1) full course from the library in its entirety). Completion is tracked within our platform.
2. Launch Your Funnel and/or Run Ads: You must take action on the business model taught in the course. This includes, at minimum, publishing a sales funnel, landing page, or advertisement directly related to the course content. Screenshots or links demonstrating this action are required.
3. Request Help in the Community: You must have made at least one (1) genuine, documented attempt to get support from our community or mentorship team if you encountered difficulties or did not achieve results. Post a question, describe your situation, and give our team or community the opportunity to assist you.
4. Request Within 7 Days: Your refund request must be submitted to [email protected] within seven (7) calendar days of your original purchase date. Requests submitted after this window will not be considered, regardless of circumstances.
5.2 How to Request a Refund
To initiate a refund request, email [email protected] with the subject line "Refund Request — [Your Full Name]" and include:
• Your full name and email address used at purchase
• Your order number or payment confirmation
• Screenshots or links showing course completion progress
• Screenshots or links showing your funnel, landing page, or ad launch
• A screenshot or link to your community post requesting help
• A brief description of what you tried, what happened, and why you are requesting a refund
Refund requests that do not include all required documentation will not be processed. We reserve the right to request additional information to verify eligibility.
5.3 Refund Processing
Approved refunds will be returned to the original payment method within 5–10 business days, depending on your payment provider. Digital Founder Academy is not responsible for delays caused by banks or payment processors.
5.4 Non-Refundable Circumstances
The following are not eligible for refunds under any circumstances:
• Requests submitted after the 7-day window
• Requests that do not meet all action-based conditions in Section 5.1
• Accounts found to be abusing the refund policy (e.g., multiple purchases and refunds)
• Resale rights usage — if you have resold, distributed, or transferred community access to any third party, you are not eligible for a refund
• Change of mind without documented action taken
5.5 Chargeback Policy
Filing a chargeback or payment dispute with your bank or credit card provider without first contacting us and following our refund process constitutes a breach of these Terms. In the event of an unwarranted chargeback, Digital Founder Academy reserves the right to:
• Immediately terminate your account and all associated access
• Revoke any resale or license rights granted to you
• Provide our payment processor and your bank with documentation demonstrating your agreement to these Terms and your failure to follow the refund process
• Pursue collection of any disputed amounts through available legal means
6. Resale Rights (Entrepreneurs Academy Members)
Members of the Entrepreneurs Academy are granted a limited, revocable license to resell access to the Entrepreneurs Academy community to third parties and retain 100% of the revenue generated from those sales ("Resale Rights").
The following conditions apply:
• Resale Rights are personal and non-transferable. You may not sublicense the right to resell to others.
• You may not misrepresent the product, its contents, or its outcomes when marketing or selling access.
• You may not use the Digital Founder Academy name, logo, or trademarks without written permission. You are selling access under your own brand unless specifically authorized otherwise.
• You are solely responsible for all customer service, refunds, and disputes arising from your resale activity. Digital Founder Academy has no obligation to support end-customers you have enrolled.
• Resale Rights are contingent on maintaining your membership in good standing. Termination of your membership (for any reason) revokes your Resale Rights immediately.
• You may not sell access at a price that denigrates or materially undercuts the published value of the product in a manner that harms the Digital Founder Academy brand.
• Digital Founder Academy reserves the right to modify, suspend, or revoke Resale Rights at any time with reasonable notice.
7. Intellectual Property
All course content, materials, videos, worksheets, templates, community infrastructure, and branding associated with Digital Founder Academy are the exclusive intellectual property of Digital Founder Academy or its licensors. You are granted a limited personal license to access and use this content for your own education and business use. You may not reproduce, redistribute, republish, resell (except as described in Section 6), reverse-engineer, or create derivative works from any Digital Founder Academy content without prior written permission.
8. Prohibited Conduct
By accessing our Products, you agree not to:
• Share your account login credentials with any other person
• Upload, share, or distribute our course materials outside of the authorized platform
• Use our community or platform to spam, harass, or solicit other members
• Make false, misleading, or unsubstantiated income claims when reselling access
• Engage in fraudulent refund requests or chargeback abuse
• Violate any applicable law, regulation, or third-party right in connection with your use of our Products
Violation of any prohibited conduct may result in immediate termination of your account without refund and, where appropriate, legal action.
9. Earnings Disclaimer
Digital Founder Academy does not guarantee any specific financial results from the use of our Products. Any income figures, case studies, or earnings examples referenced in our marketing materials are illustrative only and are not typical results. Individual results will vary significantly based on your effort, experience, market conditions, business model chosen, and many other factors outside our control. Building an online business involves real risk, and you should not purchase our Products if you are not prepared to accept that risk. Nothing in our Products constitutes financial, legal, tax, or investment advice. You should consult appropriate professionals before making any significant business or financial decision.
10. Disclaimer of Warranties
Our Products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Digital Founder Academy does not warrant that our platform will be uninterrupted, errorfree, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any aspect of our Products at any time.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Digital Founder Academy and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Products, even if we have been advised of the possibility of such damages. In no event shall our total liability to you exceed the amount you paid to us for the specific Product giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Digital Founder Academy and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Products; (b) your resale activities; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall first be subject to informal good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against Digital Founder Academy.
